Notice of Public Hearing

The ICLTA’s Measure D Ordinance’s Expenditure Plan section 6 currently provides that the Maintenance of Effort (“MOE”) amount is determined by the FY 05-06 State Controller’s Annual Report of Financial Transactions as follows: 

“Each Local Agency receiving revenues pursuant to Section 4 shall annually maintain as a minimum the same level of local discretionary funds expended for street and road purposes as was reported in the State Controller's Annual Report of Financial Transactions for Streets and Roads - Fiscal Year 2005-2006.  If any Local Agency had extraordinary local discretionary fund expenditures during FY 2005-2006, it may use, as a base for determining the minimum level of local discretionary funds, the average amount of such funds reported to the State Controller for the three-year period FY 2002-2003 through 2005-2006.  The use of a three-year average for the base period shall be subject to Authority approval.” Ordinance No.1-2008

However, the State Controller’s Annual Report of Financial Transactions has a value of $0.00 for Brawley, Calipatria, Holtville, and Westmorland while Imperial County is not listed;  and , in order to ensure that all agencies have more comprehensive and equitable annual MOE, the Ordinance’s Expenditure Plan should be amended;  and the Ordinance’s Expenditure Plan section 10 provides that the Expenditure Plan may be amended to further its purposes by ordinance or resolution, passed by roll call vote entered in the minutes, with two-thirds of the Authority concurring; and,

The proposed changes on Section 6, sentences 2-4 of the Ordinance’s Expenditure Plan are deleted and replaced by the following: 

“Continue to seek maximum funding for transportation improvements through State and federal programs while annually maintaining their existing commitment of transportation funds for purposes pursuant to this Ordinance and the Authority shall enforce this provision by appropriate actions, including fiscal audits. The Authority will not provide transactions and use tax revenue to any city or to the County unless all transportation revenues currently used by that jurisdiction continue to be used for transportation purposes.” Proposed amendment
